Choose party favors using a substantiated toy age grade, not the birthday age printed on a party category. Toy age labels should reflect the product and its intended and reasonably foreseeable use; a party-favor age group is a merchandising choice, not a substitute for that assessment. Before ordering, reconcile the age rationale, actual construction, hazard assessment, packaging and relevant test documentation. A report’s age field alone does not settle the correct label.
The legal framework below addresses U.S. sales. Buyers supplying other markets should review the destination’s requirements separately.

What determines a toy’s age grade?
Age determination requires evaluating the product and likely use, rather than accepting one label, image or report entry as decisive. CPSC considers the manufacturer’s statement of intended use and the product’s reasonably foreseeable use when determining classification. CPSC: Children’s Products
For purchasing review, examine what children actually do with the toy: the manipulation required, assembly steps, play pattern, components and likely handling. Consider the manufacturer’s proposed age label alongside packaging images and marketing language. Neither the label nor the images independently determine the correct age.
Keep statutory scope separate from the recommended play age. In the United States, a children’s product is a consumer product designed or intended primarily for children 12 years of age or younger. That definition does not mean every children’s product is suitable for every child within that range. CPSC: Children’s Products

A construction-set name does not establish the correct minimum age or warning. |
Is a small-parts warning the same as an age grade?
A small-parts warning communicates a specific hazard; it does not establish the toy’s developmental age grade. For products covered by the small-parts rule, children’s products intended for children under 3 that present a choking, aspiration or ingestion hazard because of small parts are banned hazardous substances. Adding a warning or recommending supervision does not resolve that prohibition. CPSC: Small Parts
CPSC defines a small part by whether it fits entirely into the specified small-parts cylinder, without compression and in any orientation. A photograph or casual hand inspection cannot establish the required safety assessment. CPSC: Small Parts
Certain products containing small parts, balloons, small balls or marbles have warning requirements under 16 CFR § 1500.19; advertising for toys subject to those requirements must carry the same warning under § 1500.20. Check the applicable product category rather than applying one generic choking warning to every favor. CPSC: Small Parts
What if the report, packaging and party listing show different ages?
Resolve the discrepancy before approving the listing or packaging; do not simply copy the report’s age field or choose the oldest printed age. Ask how the age determination was reached and whether the report covers the construction you will purchase, including its components and accessories.
Compare the product identity, report photographs, tested configuration, age-related test scope, proposed label and online description. A difference needs an explanation, not an automatic assumption that another test is always required.
For children’s products subject to a CPSC-enforced regulation, standard or ban, manufacturers and importers must issue a Children’s Product Certificate covering applicable requirements. The choking-hazard warning requirement itself need not be included in the CPC, so reviewing a certificate does not replace checking the artwork. CPSC: Small Parts
What should I request before placing an order?
Request a proposed age grade with its rationale, a complete component list, final packaging artwork and documentation matching the product you intend to buy. Confirm who will receive the favors, including younger siblings in mixed-age groups; choose an assessed alternative where the intended recipients fall outside the supported age range.
For the two examples above, establish the appropriate age grade, applicable warnings and documentation coverage before approving them for an age-specific assortment. Material and packaging descriptions do not answer those questions.
Use the certification information to frame your document review. For an item-specific quotation request, include the product reference, destination market, intended recipient ages and packaging requirements.
